The terms under which you may use this website and our real estate services.

These Terms of Use ("Terms") govern your access to and use of agustinrichardson.com ("the site") and any related services provided by Agustin Richardson, a licensed California real estate salesperson with First Class Real Estate (DRE #02242952) ("we", "us", "our"). By using the site you agree to these Terms. If you do not agree, please do not use the site.
1. Use of this site
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the site for personal, non-commercial purposes related to evaluating or engaging our real estate services. You may not scrape, reproduce, redistribute, frame, automate access to, or reverse-engineer any part of the site without our prior written consent.
2. Brokerage and real estate disclosures
- License. Agustin Richardson is a real estate salesperson licensed by the State of California (DRE License #02242952), affiliated with First Class Real Estate.
- Equal Housing Opportunity. We follow the Fair Housing Act and do not discriminate on the basis of race, color, religion, sex, handicap, familial status, national origin, or any other protected class.
- Not legal, tax, or investment advice. Nothing on this site is legal, tax, accounting, or investment advice. Consult your own licensed professionals before acting on anything you read here.
- Agency relationship. Use of this site does not by itself create a real estate agency or representation relationship. A buyer-broker, listing, or other written agreement is required before any agency relationship is formed.
- Information accuracy. All information is compiled from sources deemed reliable but is subject to errors, omissions, changes in price, condition, sale, or withdrawal without notice. All measurements and square footages are approximate. This site is not intended to solicit property already listed.
3. Listings and IDX
Any property information, sample listings, photos, prices, or market figures shown on this site may be illustrative, drawn from third-party feeds (San Diego MLS via IDX), or include stock imagery for layout. When you click through to view a full listing, you may be sent to a separate operator (currently sdhomelife.com) which is governed by its own terms and privacy policy. We do not warrant the accuracy, completeness, or availability of any property information, and properties may be sold, withdrawn, or change terms without notice.
4. Home value tool — automated valuation model (AVM) disclaimer
The "Get Your Home Value" / home-evaluation tool returns an automated estimate generated by algorithms. It is not an appraisal, a comparative market analysis prepared by a licensed broker, a guarantee of sale price, or a financial product. It does not create a fiduciary duty, an agency relationship, or any obligation to transact. For an actual valuation or listing strategy, please contact us directly.
5. Third-party links and embedded services
The site links to or embeds third-party services — for example, Google Maps and OpenStreetMap, Calendly, Lofty CRM, San Diego MLS / IDX feeds, social media platforms, and the brokerage's own systems. We are not responsible for the content, accuracy, or practices of third-party sites or services. Their use is subject to their own terms and privacy policies.
6. Calls, text messages, and TCPA
By checking the consent box on any form on this site, you agree to receive calls, text messages, and emails from Agustin Richardson regarding real estate services. Message and data rates may apply. Frequency varies. Consent is not a condition of any purchase. You may opt out at any time — reply STOP to any text, click unsubscribe in any email, or contact us. See the Privacy Policy for full details, including the Notice at Collection.
7. User-submitted content
If you send us testimonials, reviews, photos, videos, property descriptions, or other content via forms, email, social media, or in person ("Submissions"), you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, adapt, publish, translate, display, and distribute the Submissions in connection with our real estate services and marketing. You represent that you own or control the rights necessary to grant this license. You can ask us to stop using a Submission going forward by contacting us — though prior public use (e.g., printed marketing materials already produced) cannot be retroactively unwound.
8. Disclaimer of warranties
The site and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that any property information will match the official record.
9. Limitation of liability
To the maximum extent permitted by California law, in no event will we — or our brokerage, agents, vendors, or affiliates — be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the site or any real estate information presented on it. Our total liability for any direct damages, in the aggregate, will not exceed one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify and hold harmless Agustin Richardson, First Class Real Estate, and our respective officers, agents, contractors, vendors, and affiliates from any claim, liability, loss, or expense (including reasonable attorneys' fees) arising from (a) your use of the site, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.
11. Binding arbitration and class-action waiver
Please read carefully — this section affects your legal rights.
Except for small-claims-court matters and requests for injunctive relief to protect intellectual property, any dispute, claim, or controversy between you and us arising out of or relating to these Terms or the site will be resolved by final and binding individual arbitration administered by JAMS in San Diego, California under the JAMS Streamlined Arbitration Rules. The arbitrator's decision is final.
Class-action waiver. You and we each waive the right to bring or participate in any class, collective, or representative action. Disputes must be brought in your or our individual capacity only.
30-day opt-out. You may opt out of this arbitration provision by sending written notice to agustin@agustinrichardson.com within 30 days of first accepting these Terms, clearly stating that you opt out of arbitration. Opting out does not affect the rest of these Terms.
12. Electronic communications
By using the site or submitting a form, you consent to receive communications from us electronically. Agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing (under ESIGN, UETA, and California Civil Code §1633.1 et seq.).
13. DMCA notice and designated agent
If you believe content on this site infringes your copyright, send a notice meeting 17 U.S.C. §512(c)(3) requirements to our designated agent: Agustin Richardson, Copyright Agent, 2831 Camino Del Rio S, Ste 306, San Diego, CA 92108; email agustin@agustinrichardson.com. We will respond as required by the DMCA.
14. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Except for disputes subject to arbitration under §11, any dispute will be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to that venue.
15. Time limit on claims
Any claim arising out of or relating to these Terms or the site must be filed within one (1) year after the cause of action arises; otherwise it is permanently barred.
16. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the site.
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
- No waiver. Our failure to enforce any provision is not a waiver of that or any other provision.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, sale, or transfer of the brokerage's business.
- Headings. Section headings are for convenience and do not affect interpretation.
17. Changes to these terms
We may update these Terms from time to time. Your continued use of the site after we post updated Terms means you accept the changes. The "Last updated" date above always reflects the current version.
