Privacy Policy

How Agustin Richardson Real Estate collects, uses, and protects your information.

This Privacy Policy explains how Agustin Richardson, a licensed California real estate salesperson with First Class Real Estate (DRE #02242952) ("we", "us", "our"), collects, uses, and shares information when you visit agustinrichardson.com, submit a form, request a property list, click out to a partner listing site, or otherwise interact with us. By using this site you agree to the practices described here.

1. Information we collect

You give us (via forms): name, email, phone, ZIP code or neighborhood, buyer/seller type, timeline, free-text messages, SMS / call consent (and the timestamp + page where it was given).

Your browser gives us automatically: IP address, device + browser type, referrer URL, pages visited, time on page, language preference, and a session identifier.

Marketing attribution (stored in your browser, not on our server): UTM parameters (utm_source, utm_medium, utm_campaign, utm_content, utm_term) and ad-platform click IDs (gclid, fbclid, ttclid, msclkid). Your first visit's source is kept in your browser's localStorage for up to 90 days under the key arre_first_touch; your current-session source in sessionStorage as arre_last_touch. We read these at form-submit time so we can credit the right marketing channel.

Cookies and similar. We set a small number of first-party items in your browser (locale preference, consent choice, session ID). Third-party analytics tools we use may set their own — see §3.

2. How we use it

  • Respond to inquiries, send property matches, and schedule consultations.
  • Send the weekly buyer property list and follow-ups by email, phone, and SMS when you opt in.
  • Operate, debug, and improve the website and our services.
  • Measure marketing performance — which campaigns produce qualified leads.
  • Comply with legal obligations, including California real estate recordkeeping.

3. Analytics, cookies, and session recording

We use the following third-party tools to understand how the site is used and to fight bugs. Each can be opted out of via our consent banner (footer link: Cookie preferences) or directly with the provider:

  • Google Analytics 4 (property G-YG2VEBD9BS) — page views, click events, aggregated traffic. Opt out: Google Analytics opt-out browser add-on.
  • Microsoft Clarity (project xbwoyvdpvy) — session-replay technology that records mouse movements, scrolling, and clicks to help us improve usability. Clarity masks form-field inputs by default so we do not see what you type. Opt out: Microsoft Privacy Dashboard, or turn off the Session insights toggle in Cookie preferences.
  • Calendly — when you book a consultation, Calendly sends meeting metadata (invitee URI, event URI) which we pass into GA4 for attribution. See calendly.com/legal/privacy-notice.
  • Listing-view tracking. When you click out to view a listing on our IDX partner site (sdhomelife.com), we record the property's address, price, and status in GA4 so we can measure which listings drive engagement. We do not record what you do once you are on sdhomelife.com — they operate under their own privacy policy.

Global Privacy Control (GPC). If your browser sends a GPC signal we treat it as a request to opt out of analytics that involve advertising features, per California Attorney General guidance under CCPA §999.315.

4. Who we share with

We do not sell your information. We share it only with the service providers we use to operate the business:

  • First Class Real Estate — the licensed California brokerage under which Agustin operates.
  • Lofty CRM — your lead and any messages get added to our CRM so we can follow up. See lofty.com/privacy.
  • Google Sheets (via Google Apps Script) — lead form submissions are also written to a Google Sheet we own as a working record. Google's privacy policy applies to Google's processing.
  • Vercel — website hosting, CDN delivery, and the secure server function that proxies lead data to Lofty.
  • Calendly — consultation scheduling (see §3).
  • OpenStreetMap / Leaflet (via unpkg.com CDN) — the interactive maps embedded on this site.
  • sdhomelife.com — IDX listing partner where you view full property details.
  • Government, regulatory, or legal authorities when required by law.

5. Calls, text messages, email (TCPA)

When you check the consent box on a form, you agree to receive calls, text messages, and emails from Agustin Richardson about real estate services. Message and data rates may apply. Frequency varies based on your activity. Consent is not a condition of any purchase.

You can opt out at any time:

  • SMS: reply STOP to any text. Reply HELP for help.
  • Email: click the unsubscribe link in any marketing email.
  • Calls: tell us during a call, or email agustin@agustinrichardson.com.

6. Your California privacy rights (CCPA / CPRA)

If you are a California resident, you have the right to:

  • Know what personal information we have collected about you.
  • Delete personal information we have collected from you (subject to legal recordkeeping exceptions).
  • Correct inaccurate personal information.
  • Limit our use of sensitive personal information (we do not currently collect sensitive PI as defined by CPRA).
  • Opt out of sale or sharing for cross-context behavioral advertising — we do not sell or share for that purpose.
  • Non-discrimination — we will not retaliate against you for exercising any of these rights.

How to make a request. Email agustin@agustinrichardson.com with the subject line "California Privacy Request," or send a letter to the address below. We may need to verify your identity by matching it to information we already have on file.

Authorized agents. You may designate an authorized agent to make a request on your behalf. We will require (a) written authorization signed by you, and (b) verification of the agent's identity.

Shine the Light (CA Civil Code §1798.83). California residents may request, once per year, a list of categories of personal information disclosed to third parties for those third parties' direct marketing. We do not disclose personal information to third parties for their own direct marketing.

7. Data security

The site is served over HTTPS. Lead data is transmitted over encrypted connections to our CRM and Sheets backends. The Lofty API key sits in a server-side environment variable and is never sent to your browser. Access to the underlying Google Sheet and Lofty account is limited to the brokerage team. No security control is perfect — if we become aware of a breach affecting your personal information we will notify you and the California Attorney General as required by Civil Code §1798.82.

8. Data retention

We keep lead and client information for as long as needed to provide our services and comply with our recordkeeping obligations under California real estate law (typically a minimum of three years for transaction records). Marketing attribution stored in your browser's local storage expires automatically after 90 days. We delete or anonymize older information when it is no longer needed.

9. Children

This site is intended for adults seeking real estate services. We do not knowingly collect personal information from children under 13 (COPPA) or, in California, from anyone under 16 without their authorization. If you believe a minor has submitted information, please contact us and we will delete it.

10. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date above. Material changes will be highlighted at the top of the page for a reasonable period.
